Straightforward Divorce Situation
Our firm's mediators specialize in drafting comprehensive divorce settlements and (what are called) straightforward divorce situations. These situations vary considerably, however, there are some basic similarities.
- A jointly-owned primary home.
- A first mortgage in both names. May or may not have an equity line of credit
- One or both spouses have 401(k), 403(b) or Individual Retirement Accounts
- Planning for payment of college expenses
- Minimal disparity between the income of the spouses
- A mixture of individual and joint bank and brokerage accounts
- Moderate charge card debt
- A health insurance policy that covers all family members
- Life insurance on the higher income spouse
- Clients who require some, but not extensive, consideration of tax issues
*Straightforward situations typically do not have trusts, rental property, business ownership or significant inheritances or premarital property [See Complex Situations]
- No disagreement regarding custody
- The income of each spouse is less than $100,000 and the total family income is less than $135,000
Your mediator will explain and help you reach agreement on all aspects of divorce: future sale/ownership of your primary residence, transfer/division of retirement funds, child custody, child support, alimony or waiver of alimony, health insurance, tax issues, and payment of college expenses.
